Defendant Jason San Diego, through undersigned counsel, hereby moves this Court to continue the evidentiary hearing, currently scheduled for June 22, 2007, for approximately one week. Undersigned counsel has previously committed to be a featured presenter

21 at the Fifth Annual Arizona Public Defender Association (APDA) Conference, in 22 Tempe, Arizona, on the morning of June 22, 2007. Counsel therefore respectfully 23 requests that this Court enter an order continuing the hearing in this matter for 24 approximately one week, but would request that the hearing not be set on Friday, June 25 26 27 28 29, 2007, as he will be unavailable on that date. Undersigned counsel has contacted Diane Humetewa, the Assistant U.S. Attorney assigned to this case. Ms. Humetewa has indicated that the government makes no objection to the requested continuance.
