) And Related Counterclaims, Cross-Claims, ) and Third-Party Claims. ) ) The Motion for Court of Appointment of Technical Advisor (Dckt. 387) ("Motion for Technical Advisor") asks the Court to either (1) look at the two versions of Lexcel Software to determine if there is any real dispute as to whether the Lexcel 2001 software is substantially similar, derivative of or an update of Lexcel's 94/95 software, or (2) appoint a technical advisor to advise the Court whether there is any genuine factual dispute regarding whether the Lexcel 2001 software is substantially similar, derivative of or is an update of Lexcel's 94/95 software.

The Motion for Technical Advisor contains no "insufficient defense or any redundant, immaterial, impertinent, or scandalous matter," FED.R.CIV.P. 12(f), so Nelcela's Motion to Strike is unfounded. Moreover, Nelcela's Motion to Strike is an obvious effort to divert attention from the substance of the Motion for Technical Advisor. The Motion for Technical Advisor contains no new expert report, as Nelcela contends. Rather, the sole exhibit to the Motion for Technical Advisor is a simple redline comparison of the actual 94/95 and 2001 Lexcel source codes produced in this lawsuit. That redline comparison contains no expert opinion and introduces no new evidence ­ just the verbatim text of the Lexcel source code. Surely, if there were any inaccuracies in the redline comparison, Nelcela could have and would have pointed them out for the Court. In sum, Nelcela's Motion to Strike should be denied.
