Pursuant to the Final Pretrial Conference held on Tuesday, April 3, 2007, undersigned counsel met and conferred with counsel for the "Joint Parties" as directed. Though counsel attempted to agree upon a Brief Statement of the Case and Revised Preliminary Jury Instructions, the parties were not in agreement on what should be filed and/or read to the Prospective Jury/Jury. Thus, Nelcela, Inc., Len Campagna and Alec Dollarhide (collectively "Nelcela") hereby submit their own Brief Statement of the Case as Exhibit A, attached here and incorporated by this reference, and their own Revised Preliminary Jury Instructions as Exhibit B, attached and incorporated herein.
