Pursuant to this Court's order at the Final Pretrial Conference on March 26, 2007,

16 docket no. 454, the Joint Parties hereby provide notice that they were permitted to depose 17 the Nelcela Parties' expert, Kevin Faulkner, on Wednesday, March 28, 2007. 18 The Joint Parties also hereby provide notice of their intent to call a rebuttal expert

19 to address the opinions expressed by Mr. Faulkner. 20 The POST Parties have requested an expedited transcript of Wednesday's

21 deposition, which they have not yet received.
