The Nelcela Parties' Reply to their Motion for Judgment as a Matter of Law

20 accuses the Joint Parties of acting unethically by failing to cite the Apple v. Microsoft 21 case1 to the Court in our 2006 summary judgment papers. (E.g., Dckt. 524 at p.1 & 6). 22 As a point of fact, not only did the Joint Parties have no duty to make summary judgment 23 arguments for Nelcela, but Nelcela's accusation is erroneous: The Joint Parties cited the 24 Apple case in both our Motion for Summary Judgment re Ownership of Software (see 25 Dckt. 333 at p.10, lns. 11-13) and our Reply in Support of Motion for Summary 26 Judgment re Ownership of Software (see Dckt. 358 at p.8, lns. 8-9). 27
