No. CIV 02-1954-PHX-MHM JOINT PARTIES' MOTION FOR LEAVE TO FILE A MOTION FOR PARTIAL SUMMARY JUDGMENT BASED ON THE JURY'S VERDICT

In accordance with the Court's Rules of Practice in Civil Cases, the Lexcel, POST,

19 and MTSI Parties move the Court for leave to file a motion for summary judgment 20 directed at Nelcela's counterclaims and cross-claims alleging copyright infringement and 21 conversion. A motion for summary judgment limited to these claims is appropriate at 22 this time because the jury's verdict has resolved all issues necessary for entry of 23 judgment on these claims. Moreover, we believe that resolution of these claims now will 24 result in the most just, speedy, efficient, and inexpensive means for determination of both 25 these claims and the other claims remaining at issue. 26 27 28
