20 In particular, Nelcela seeks to avoid responding to the Joint Parties' Motion for Partial 21 Summary Judgment on Nelcela's Claims of Copyright Infringement, Conversion, and 22 Aiding and Abetting Tortious Conduct ("the Motion") because Nelcela has no defense on 23 the merits to the Motion. As a matter of law, the jury's verdict that Lexcel, rather than 24 Nelcela, owns the software at issue in this lawsuit is fatal to Nelcela's claims of copyright 25 infringement, conversion, and aiding and abetting tortious conduct. 26 The jury has spoken, and Nelcela should be held to the consequences of the jury's

27 verdict. We have no objection to postponing the Motion until after resolution of 28 Nelcela's pending motion for judgment as a matter of law (Dckt. 506). What we ask is
