The parties hereto, by and through their respective counsel, hereby submit this Stipulated Motion for Stay and Approval of Supersedeas Bond pursuant to Rule 8(a), Federal Rules of Appellate Procedure. This Court entered a final judgment on June 14, 2005, in favor of Plaintiffs and against all Defendants in the total amount of $1,914,040.24. Defendants timely filed their Motion for Reconsideration on June 28, 2005, which was denied by the Court's order entered on January 31, 2006. Defendants intend to file a notice of appeal from the June 14, 2005 judgment and the January 31, 2006 order denying Defendants' Motion for Reconsideration. The parties agree that a supersedeas bond in the amount of $2,500,000.00 is sufficient during the pendency of an appeal. Thus, the parties move this Court to approve the amount of the supersedeas bond, and stay the judgment pending appeal based on the imminent filing of the supersedeas bond. ...
