The parties hereby notify the Court that they have tentatively reached a settlement in this Litigation, and of the underlying dispute. They are currently working out the details of the settlement, and working to complete the necessary documentation to memorialize the settlement and to formally and jointly move the Court to dismiss the case with prejudice. Although the parties anticipate completing settlement and filing a motion for dismissal imminently, given that the negotiations and documentation are not yet complete, the parties alternatively move the Court for an enlargement of time of five business days for all documents and things called for in the Court's Order Setting Final Pretrial Conference for February 10, 2005, thereby extending the due date to February 17, 2006. The parties are not submitting this for any purposes of delay. DATED this 10th day of February, 2006.
