1 The Brewer Defendants did not receive the Transcript of the Testimony of Jay Beltz
2 from the Court Reporter sufficiently in advance of the time in which they completed,
3 lodged and served the [Brewer Defendants’ Proposed] Findings of Fact and Conclusions of
4 Law, to be able to include specific references to Mr. Beltz’s testimony therein.
5 Accordingly, the Brewer Defendants referred generally to Mr. Beltz’s Testimony and
6 indicated at page 10, footnote 9, that they would supplement their proposed Findings of
7 Facts and Conclusions of Law with specific references to Mr. Be1tz’s Testimony once the
8 Transcript was received. Therefore, the Brewer Defendants hereby submit the following
9 Notice of Supplement to the [Brewer Defendants’ Proposed] Findings Of Fact And
10 Conclusions Of Law to Insert References to the Testimony of I ay Beltz:
11 1. At paragraph 48 on page 11 of the [Brewer Defendants’ Proposed] Findings
12 of Fact and Conclusions of Law, the reference to Mr. Beltz’s testimony should be: Beltz
13 Testimony (4-18-06, Partial Transcript) 106:24-14, 108:24-111:4.
14 2. At paragraph 51 on page 12 of the [Brewer Defendants’ Proposed] Findings
15 of Fact and Conclusions of Law, the reference to Mr. Beltz’s testimony should be: Beltz
