19 The Plaintiff, pursuant to Rule 6(b) Fed.R.Civ.P., upon good cause shown, moves this
2O Court for an enlargement of the briefing schedule previously set.
2] MEMORANDUM OF POINTS AND AUTHORITIES
22 This Court has allowed the Plaintiff to present a rebuttal to the expert testimony of
23 defense witness, Kurt Piper, by means of a Declaration from Thomas Shardlow. The deadline
24 for submission of this Declaration is May 12, 2006.
25 The Court was informed that Mr. Shardlow would be on vacation and out of the country
26 from April 25, 2006 to May 10, 2006. Since his return, Mr. Shardlow has been suffering from

1 an extreme case of food poisoning and has been totally incapacitated. As a result Mr. Shardlow
2 has been unable to give any attention to the review of Mr. Piper’s testimony and the preparation
3 of his rebuttal. The food poisoning is slowly running its course and it is believed that a short
4 extension of the briefing schedule, which would allow the Declaration to be submitted on
5 Wednesday, May 17, 2006, the parties’ Findings of Fact and Conclusions of Law on Friday,
6 May 19, 2006, and the parties’ Replies on Wednesday, May 24, 2006, would be reasonable in
7 view ofthe good cause shown.
8. This motion is supported by the Declaration of the Plaintiff
