UNITED STATES DISTRICT COURT DISTRICT OF ARIZONA United States of America, Plaintiff, vs. Francisco Javier Andrade-Martinez, Defendant. ) No. CR 00-1186-PHX-SMM ) ) ) ORDER ) ) ) ) ) )
IT IS HEREBY ORDERED granting defendant's Motion to Continue Trial and Extend Time for Filing Motions. This court specifically finds that the ends of justice served by taking such action outweigh the best interest of the public and the defendant in a speedy trial. 18 U.S.C. §3161 (h) (8) (A). This finding is based upon the court's conclusion that the failure to grant such a continuance would deny counsel for the defendant and the attorney for the government the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. §3161 (h) (8) (B) (iv). IT IS ORDERED that the trial date of June 6, 2006 in this matter be reset to July 5, 2006 at 9:00 a.m. IT IS FURTHER ORDERED vacating the status conference on May 23, 2006 at 2:30 p.m.
