18 Pursuant to this Court’s Minute Order of August 15, 2007, Piaintifi Northern .
19 Wisconsin Produce Company, Inc. (“Northern Wisconsin"), herewith submits its twelth report I
20 regarding the status ofthe criminal action commenced by the United States against Steven
21 Deiaportas in the United States District Court for the District of Arizona at Case No. O5—CR—1—
22 ALL ("Crimina1 Action").
23 After numerous continuances, Judge Martone conducted the sentencing hearing inthe
24 Criminal Action on October 18 and October 23, 2007. Judge Martone accepted Steven
25 Deiaportas’ plea agreement and sentenced him to five years probation and ordered a restitution E
26 payment in the amount of $28 1,737.32, S 160,000 of which was required to be paid on

i October 23, 2007. Mr. Delaportas is also required to attend a business ethics seminar. At the
2 sentencing hearing, Judge l\/lartone several times mentioned his belief that the restitution
3 awarded against Mr. Delaportas and in favor of Northern Wisconsin established a floor for .
4 minimum liability owed by Mr. Delaportas to Northern Wisconsin. Judge l\/lartone correctly
5 indicated this civil action would need to be concluded before the maximum liability could be
6 established in favor of Northern Wisconsin and against Delaportas.
7 Now that the Criminal Action has concluded and will soon be reduced to Judgement,
S Northern Wisconsin requests that this Court: set a conference with the parties to establish a
9 comprehensive scheduling order.
l0 WHEREFORE, it is respectfully requested that this Court enter its Order setting a
ll scheduling conference some time before the end of this calendar year.
