18 Pursuant to this Court’s Minute Order of April 6, 2007, Plaintifti Northern Wisconsin
19 Produce Company, Inc. ("Northeni Wisconsin"), herewith submits its eleventh report
20 regarding the status of the criminal action commenced by the United States against Steven
2i Delaportas in the United States District Court for the District of Arizona at Case No. 05—~CR-—l—-
22 ALL ("Criminal Action").
23 This civil action has been held in abeyance pending resolution ofthe Criminal Action.
24 Steven Delaportas’ plea agreement with the United States has been approved by the Court.
25 The sentencing hearing has been continued many times, most recently to August 29, 2007 at

i 2:00 p.m.. However, counsel for the United States has a trial conflict and will be seeking a
2 continuance of Mr. Delaportas’ sentencing hearing to a date in October. _
3 Northern Wisconsin continues to contend this civil action should remain in abeyance
4 until restitution has been determined by the Court in the Criminal Action. g
5 WHEREFORE, it is respectfully requested that this Court continue to hold this civil
6 action in abeyance until a date subsequent to the continued sentencing hearing, a date likely to
7 occur in October 2007. {5/
