By the court's order of October 15, 2007 (Docket No. 407), liability issues in this case as to one of two remaining defendants have been decided. By order of October 15, 2007 (Docket No. 406), the

other remaining defendant's motion for summary judgment has been granted in part and denied in part. As to Snell & Wilmer, liability

issues and damages issues remain for trial, and are presently scheduled for January 29, 2008. As to defendant Thimmesch, damages will be taken up separately at a later date. A court-assisted settlement conference will be conducted in this case by Magistrate Judge Duncan on November 1, 2007. By order of

September 24, 2007 (Docket No. 399), the court advised that it would conduct a preliminary pretrial conference in this case on November 13, 2007, at a time to be decided. Counsel will please confer with one another and, on or before October 24, 2007, they shall jointly or severally confer with the court's judicial assistant (Marty Stafford; 907.677.6252) for purposes of arranging a time for the preliminary pretrial conference, which will be held on November 13, 2007, if the case is not settled as a result of the November 1 settlement conference.
