Pursuant to Fed. R. Civ. P. 41(a)(1)(ii), the parties to the above referenced case stipulate that this matter is dismissed with prejudice. Plaintiff, Save our Sonoran, Inc., and defendant, City of Phoenix ("City") have agreed to settle the dispute in this matter. Such settlement will allow those activities necessary to complete the City's water main project to go forward in compliance with the United States Army Corps of Engineers' ("Corps") nationwide permits applicable to the project. Pursuant to the settlement, the anticipated pump station and appurtenant features will be constructed in a manner that does not result in the discharge of dredged or fill materials to the jurisdictional washes in Section 16. As part of the settlement, all claims in this action, including those against the Corps, and any individually named defendants, are to be dismissed with
