MOTION FOR EXTENSION OF TIME TO RESPOND TO PETITIONER'S DISCOVERY REQUEST (First Request)

Respondents respectfully request an extension of time, to and including

18 November 4, 2005, in which to respond to Petitioner's motion for discovery. The 19 requested information relates exclusively to Petitioner's motion to amend his 20 federal habeas petition based on his allegation of newly discovered evidence, and 21 this Court has generously extended the time in which Respondents can respond to 22 that motion until November 4, 2005. 23 For this reason, Respondents wish to jointly file a response to both the 24 underlying motion to amend as well as the motion for discovery that itself relates 25 exclusively to the underlying motion to amend. 26 27 28
