19 Respondents respectfully request a 45—day extension of time in which to tile
20 their response to Petitioner’s "Motion to Amend Writ of Habeas Corpus Pleading
21 Due to Evidence Newly Discovered Through Due Diligence" (Doc. 35), producing
22 a new tiling deadline of November 4, 2005.
23 Undersigned counsel made his appearance in this case on August 18, 2005
24 (Doc. 36), a date before which Respondents’ previous counsel answered the
25 petition, Magistrate Judge Fiora issued her Report and Recommendation, and
26 Petitioner tiled his objections and corresponding exhibits. The propriety of
27 Petitioner ’s motion requires reviewing l7 volumes of the Reporter’s Transcript and
Z8 the voluminous exhibits that Petitioner attaches to his motions. In addition,

1 undersigned counsel’s time has been limited by other required work for this Court
2 and the state courts, including writing a 40—page answering brief in
3 Dottavio, 1 CA—CR 05-0134 (filed Sept. 9, 2005), answering the habeas petition in
4 Washington v. Schriro, CIV 04—548—TUC—CKJ (filed Sept. 16, 2005), and
5 petitioning for review in the Arizona Supreme Court in State v. Buiwell, 1 CA—CR
6 04-0371 (filed Sept. 19, 2005).
7 Undersigned counsel apologizes to this Court and to Petitioner. This request
S is made in good faith, and not for purposes of undue delay.
