The Court, having considered the parties Joint M otion to Bifurcate Consideration of M otion for an Award of Attorneys' Fees and Non-Taxable Expenses filed herein and good cause appearing therefor, IT IS ORDERED granting the Joint M otion to Bifurcate and, IT IS FURTHER ORDERED that Eberle's M emorandum of Points and Authorities in support of its M otion for Award of Attorneys' Fees and Relat ed N on-Taxable Expenses shall address only the issues of eligibility and entitlement as described in LRCiv 54.2(c)(1) and (2) and shall be filed on or before December 5, 2005. The Response and Reply thereto shall be filed in accordance with Local Rule of Civil Procedure 7.2, and IT IS FURTHER ORDERED that Eberle shall have fourteen (14) days following the Court 's ruling on Eberle's M otion for Award of Attorneys' Fees and Related Non-Taxable Expenses to file a M emorandum of Points and Authorities and the supporting documentation setting forth the amount requested and discussing the reasonableness of that reques t in accordance with LRCiv 54.2(c)(3), (d), and (e). The Responsive M emorandum shall comply with LRCiv 54.2 (f) and the provisions of LRCiv 54.2 (b)(3) shall govern t he t iming of filing of the Responsive and Reply M emoranda.
