RESPONSE IN OPPOSITION TO MOTIONS FOR EXTENSION

Plaintiff Lemelson Medical, Education & Research Foundation, Limited Partnership ("Lemelson") opposes the motions for extension of time by defendants Ingram Industries, Inc. and Nash-Finch Co. to file the detailed support of their motions

for attorneys' fees as required by Local Rule 54.2. These defendants, represented by the same counsel, have failed to present any good cause for the requested extension. The only excuse provided is that "lead counsel" has been too busy. These defendants are represented by two large law firms, Merchant & Gould (an IP firm with over 100 lawyers) and Snell & Wilmer (over 200 attorneys in Phoenix alone). It is difficult to imagine that neither firm has any attorney who could prepare the supporting documentation in a timely fashion. The small size of the requests (Nash Finch estimated $14,000 and Ingram $7000 in fees) shows that major work was not needed. These defendants have had sixty days to prepare this documentation following entry of judgment. In that time, they have not even managed to make a single telephone call to consult with Lemelson's counsel as required by Local Rule 54.2 (d)(1). Nor did they comply with Local Rule 7.3, requiring consultation before moving for an extension. These defendants are among a very small minority that moved for attorney fees following the dismissal. Their delay will no doubt delay resolution of the matter for all (including Lemelson). Their failure to timely address an issue that has been on their calendar for two months should not be allowed to prejudice others. Accordingly, the motion should be denied.
