24 The defendant was represented in the above-captioned matter by undersigned
25 counsel. He was charged by way oflnformation with a violation ofTitle 8 U.S.C.
26 section l326(a), enhanced by section (b)(2). He accepted a Plea Agreement and
27 pleaded guilty pursuant to its terms. He was sentenced on November 25, 2003 by this
28 Court.

1 The defendant has requested this Court issue an Order requiring
2 undersigned counsel to provide him with the court transcripts ofthe case. The Court
3 should deny the motion because there are no transcripts within counsel’s possession.
gl As far as undersigned counsel knows no transcripts of any proceedings in this matter
6 were ever ordered.
7 ln order to attempt to satisfy the defendant, undersigned counsel,
3 contemporaneously with this filing, will send to the defendant a copy of the
9 Information, the Plea Agreement, the J&C order and 46 pages ofthe investigative
10 reports, court records of priors etc. which make up the discovery counsel received in
I 1 this matter. Counsel will refrain from sending the defendant a copy ofthe PreSentence
I2 Report unless this Court so orders.
