The United States of America, by and through its attorney, the United States Attorney for the District of Arizona, responds herein to defendant's Motion for a Newly Appointed U.S. Defense Attorney 1/ . The government does not take a position on defendant's request for newly appointed counsel. To the extent the defendant requests a new trial, the government requests that this court deny relief for the reasons that (1) the motion is far in excess of the page limits defined by Local Civil Rule 7.2(e), and (2) the request is untimely pursuant to Fed.R.Crim.Pr. 33, and (3) this court has already heard and denied defendant's previous requests for new trial on July 14, 2005 (docket #139), and in court on March 1, 2006.

Given the length of defendant's Motion title, it is abbreviated herein. Its full title is: Motion for a Newly Appointed U.S. Defense Attorney to Properly Assist in Immediate Filing of a Legal Writ of Habeas Corpus, Along With Legal Representation for Habeas Corpus Based on Ineffective Assistance of Counsel (docket #180).
