On April 6, 2007, the oral argument panel issued an order referring to the
appellate commissioner the pro se motion to order and compel, which concerned
the level of communication between appellant and his counsel. Due to clerical
oversight, the order was transmitted to the appellate commissioner for the first
time on October 26, 2007. A review of the docket reveals that the oral argument
panel has since denied the appellant’s petition for en banc rehearing and granted
appellant’s counsel’s motion to withdraw. The United States Supreme Court
denied appellant’s petition for a writ of certiorari on October l, 2007.
. In light of the resolution of the case since the April 6, 2007 referral order, V
the motion to order and compel is denied as moot. 4
