(First Request) The United States, through counsel undersigned, moves to continue the re-sentencing following remand in this matter, because undersigned counsel will be out of the District on Monday, May 22, 2006, the date scheduled for re-sentencing. Each counsel in this case has extended vacations scheduled for the summer months (undersigned counsel from June 12 through June 23, and Mr. LaBarge from the end of June through most of July), and accordingly the parties request that the Court set re-sentencing either between May 24 and June 9, or on or after August 1. Neil LaBarge, counsel for defendant, has been contacted about this motion, and he has no objection. Excludable delay under 18 U.S.C. ยง 3161 may occur as a result of this Motion or of an Order based on this Motion.
