Pursuant to the Order of February 9, 2006, the government, through counsel undersigned, notifies the Court that it will not be filing a petition for certiorari. Consistent with the Court of Appeals mandate, the government has no objection to a resentencing proceeding for the Court to 1) reconsider the imposition of the ransom demand and multiple victim enhancements; and 2) decide whether to follow the advisory Sentencing Guidelines in imposing a reasonable sentence on defendant. The government asserts that the enhancements are supported by the requisite post-Booker standard, that is, a preponderance of all the evidence adduced at trial or unchallenged in the PSR, and that the original sentence of 121 months is a reasonable sentence.
