CR03-1106-1-PHX-SMM Defendant's Supervised Release Disposition Memorandum

Defendant hereby submits his Supervised Release Disposition Memorandum. The Report issued by the Probation Officer is essentially correct. Defendant admits that he did violate the terms of his release. However, there are additional facts that Defendant wishes to make the Court aware in deciding his fate. When Defendant was released from State custody he immediately got a job and was doing well on probation. However, Defendant has a long history of drug addiction and soon the pressure of life with reporting requirements to two agencies, both and state and federal, got to him. Defendant had secured good employment, but his employer told him that they could not keep him as he had too many obligations to too many courts. He was constantly having to report to different officers, on their schedule, and he was unable to keep up with his work requirements. Defendant then tried to make a go of it on his own by starting his own tattoo business. Defendant is an accomplished tattoo artist. The Court officials, both state and federal, were unimpressed by his efforts and they wanted him to obtain regular employment. Defendant did not feel that he could maintain regular employment as he had lost a good job due to reporting requirements placed on him. Defendant quickly fell apart and now is back in front of this Court. Defendant

Defendant requests that the Court allow him one more chance and that the Court order that he be released as soon as a bed becomes available at a facility operated by Mr. Gaston.
