Defendant, by and through undersigned counsel, hereby requests the Court continue the hearing currently set for January 7, 2008, at 1:30 p.m. for the reason that counsel for the Defendant has a court calendar conflict. Counsel is currently scheduled to appear at 1:15 p.m. before United States District Court Judge Mary H. Murguia in the matter of United States v. Antonio, No. CR07-332-PHX-MHM, at 1:30 p.m. United States District Court Judge Stephen M. McNamee in several matters involving United States v. Garcia-Moreno, No. CR06-989-PHX-FJM, and at 4:00 p.m. before United States District Court Judge Mary H. Murguia in the matter of United States v. Hill, No. CR200600580-001-PHX-MHM. This counsel has attempted to contact Assistant U. S. Attorney Darcy Cerow and she is currently unavailable to respond as to whether she has any objection to this request. This motion is made in good faith and not for purposes of delay. The interests of justice served by a continuance outweigh the interests of the Defendant and the public in a speedy hearing. Excludable delay under 18 U.S.C. §3161(h) will occur as a result of this motion or from an order based thereon.
