The United States of America, by and through its attorney undersigned, hereby requests

16 that this Court dismiss the following charges contained in the Second Superseding Indictment 17 with prejudice: Counts 5, and 12-15 against defendant Craig T. Kelly; Counts 5, 10 and 11 18 against defendant Henry E. Watkins; and Count 7 against defendant Robert T. Rienstra. The 19 United States and defendants Craig T. Kelly, Henry E. Watkins, and Robert T. Rienstra further 20 stipulate that the United States has no further obligation to provide any additional discovery in 21 this case. 22 Defense counsel, Joseph E. Abodeely for defendant Craig T. Kelly, Carmen L. Fischer

23 for defendant Henry E. Watkins, and Philip A. Seplow for defendant Robert T. Rienstra have 24 been contacted and they have no objection to the Motion to Dismiss with prejudice, and they 25 concur with the stipulation for no further discovery. 26 The United States believes a dismissal of the aforementioned charges with prejudice

27 would be in the interests of justice at this time. 28
