UNITED STATES DISTRICT COURT DISTRICT OF ARIZONA United States of America CR-03-1294-PHX-ROS Plaintiff, v. Jeremy Eugene Staffeldt, et al., Defendants. MOTION TO DISMISS INDICTMENT

The United States of America, by and through its attorney undersigned, hereby requests

16 that this Court dismiss the charges contained in the Indictment against defendants JEREMY 17 EUGENE STAFFELDT (Counts 1 and 2), ORLANDO LEON PASTRANO (Counts 1 and 2), 18 LINCOLN CLARENCE METZGAR (Count 1) and JOHN ANTHONY GONZALES (Count 19 1) without prejudice. The reason for this Motion is that the Court's order granting the 20 defendants' motion to suppress precludes the United States from introducing the evidence 21 obtained from the wiretap and search warrants. Accordingly, a dismissal of these charges 22 without prejudice would be in the interests of justice at this time. 23 Counsel for the defendants, Cameron A. Morgan for defendant STAFFELDT, Antonio 24 D. Bustamante for defendant PASTRANO, Marc J. Victor for defendant METZGAR, and 25 Antonio R. Zuniga for defendant GONZALES were notified of the United States' Motion to 26 Dismiss without prejudice. Counsel for all defendants have no objection to the dismissal, but 27 will file a motion seeking a dismissal with prejudice. 28
