IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA
UNITED STATES OF AMERICA, Plaintiff, vs.
) ) ) ) ) ) ) ) ) ) ) )
CR-03-50065-PHX-FJM ORDER
The court has before it the defendant's motion for reconsideration (doc.10). Counsel relies on LRCiv 83.3(a) with emphasis on the words "until the time for appeal." There is ambiguity in the rule because one would have expected the words "has expired" to follow the word "appeal." Nevertheless, the issue is moot because the United States has filed a notice of service of documents on the judgment debtor. Accordingly, the effect of service on counsel is moot. IT IS THEREFORE ORDERED DENYING the motion for reconsideration on grounds of mootness (doc. 10). DATED this 10th day of November, 2005.
