In its Opposition to C21's Motion to Exclude, Century erroneously stated that declarations filed prior to close of discovery included the names of over 500 entities that had been contacted telephonically. The correct number is about 167 contacted telephonically prior to the close of discovery. Century did telephonically contact over 300 additional related third-party "Century" users after the close of discovery (and thus over 500 total) to verify that they were in business and using the "Century" marks. This mistake resulted from Century's error regarding the dates of the declarations describing the telephone calls, which supplemented the lists of names produced. Century apologizes for any inconvenience this may have caused the Court or opposing counsel.
