Counsel are to advise the Court in writing by 10/10/05 whether the parties consent to proceed before a magistrate judge or have the trial rescheduled before this Court in late 2006. The Court approves the parties' Joint Proposed Pretrial Order. Discussion held re: pending motions in limine. For reasons as stated on the record, Plaintiff's Motion in Limine re: Corporate Incentive Program [doc. 189] is deemed moot as defense counsel is not offering the documents at trial. Defendant's Motion in Limine, Issue #3 [doc. 197] is deemed moot as the documents have been withdrawn. The issue may be raised, if at all, exclusively on impeachment.
