Undersigned counsel hereby gives notice of settlement with respect to all parties, and all claims herein. The parties will submit a Stipulation to Dismiss and an Order of Dismissal with Prejudice upon finalization of the settlement agreement. Due to the pending settlement of this matter, Defendant herewith joins in Plaintiff's previously submitted Motion to Continue Deadlines for Marking Exhibits and Exchange of Marked Copies of Exhibits, and further requests that the deadline for submission of all pretrial filings, including the pretrial order, Motions in Limine, jury instructions, voir dire questions, proposed form of verdict, and stipulated case description, be extended briefly, to allow the settlement to be finalized and the case to be dismissed. The brief extension sought ­ to October 7th, 2005 ­ will not unduly delay this matter, and will not prejudice either side. The Final Pretrial conference is currently set for October 12, and the defense expects the Stipulation to Dismiss to be filed during the week of October 3, 2005.
