Plaintiff, Jerry Simms, asks this Court to take judicial notice under FRE 201 that the seller of real property in Arizona must make disclosure to any prospective purchaser of any known defect or condition in the property that the seller knows would be material to any prospective purchaser. Source: The S. Development Company v. Pima Capital Management Co., 201 Ariz. 10, 31 P. 3d. 123 (App. 2001).
