16 Pursuant to Local Civil Rule 83.7(a), counsel stipulate that Plaintiff Jerry
17 Simms does not claim in this matter that water damage occurring or discovered after
18 January l, 2004 is the responsibility of State Farm, Defendant herein, nor does Plaintiff
19 claim that Defendant is liable for repairs related to said damages. Mr. Simms has filed a
20 separate lawsuit in which Nance Construction, Inc., Northeast Valley Roofing, Cobra
21 Stucco, LLC and Dusty Creek Builders are named as defendants. In that lawsuit, Mr. Simms
22 alleges damages for construction defects and moisture related damages. Horizon Stucco,
23 owned by Ron McDonald, is not named in that lawsuit.
