19 William R. Phillips, being first duly sworn upon his oath, deposes and states:
20 1. I am counsel for Defendant and make this Affidavit based upon personal
21 knowledge.
22 2. In his Memorandum in Support of the Bill of Costs, Plaintiff indicates that
23 the backup documents for fees of service of summons and subpoena are contained in
24 Exhibit 2. The eight charges set forth in Exhibit 2 to the Bill of Costs total $1,014.70
25 rather than the amount set forth in the Bill of Costs.
26 3. Also in his Memorandum in Support of Bill of Costs, Plaintiff indicates that

1 fees of the court reporter include only court reporter expenses throughout discovery and
2 trial. Exhibit 3 to the Bill of Costs attaches numerous court reporter’s billings. The
3 exhibit also contains two invoices for professional time from defense expert witnesses
4 deposed by Plaintiff.
5 4. A billing from Gervasio & Associates, Inc. in the amount of $406.05 was
6 invoiced on October 12, 2005. A copy of the original invoice number 2396 is attached
7 hereto. The invoice arose from the deposition of John Denny taken September 12, 2005.
8 These actual charges billed for responding to a Subpoena Duces Tecum are not taxable
9 under 28 USC § 1920.
10 5. Exhibit 3 to Plaintiff s Bill of Costs also includes a billing from Legend
11 Technical Services of Arizona, Inc. dated July 1, 2004. Legend co—owner Cheryl Sykora
12 was deposed by P1aintiff’s counsel on June 22, 2004. According to the deposition
13 transcript, the deposition began at 10:00 a.m. and ended at 1:48 p.m. Once again, this
14 billing for three hours of professional time is non—recoverable.
15 6. Under Local Rule 54.1(e)(3), fees for witnesses at deposition are "taxable at
16 the same rate as for witnesses at trial." Accordingly, the professional time of these expert
17 witnesses is not a compensable statutory cost.
18 7. Additionally, Plaintiff has miscalculated the total sum of the invoices
19 included as Exhibit 3. Invoices included within Exhibit 3 total $4,787.12, rather than the
20 amount set forth in the Bill of Costs.
