Dear l\/lr. Tucker:
This letter will confirm our fee agreement regarding my legal representation of you in I
connection with your legal claims against the City of Tempe.
Specifically, i have agreed to represent you in connection with your claims against the
City in consideration of receiving one-third (33.3%) of any monies that I obtain on your behalf by
means of settlement. I
lf at the conclusion of a successful trial, i am awarded attorney fees, l will be entitled to T
accept either (1) the award of attorney fees or (2) one-third (33.3%) of the combined amount of
attorney fees and the money damages awarded to you. ln most cases, I will elect to accept the g
greater amount.
lfl fail to recover any monies on your behalf at any level of litigation, you will owe me
nothing by way of attorney fees, but you will be liable for (1) any litigation costs incurred by my ‘
law firm in connection with prosecuting your case and/or (2) any litigation costs awarded to the _
