17 of Civil Procedure, hereby respond to Plaintiff? First Request For Admissions [Nos. l thorough
18 49) and Second Set of Interrogatories (Nos. 28 through 29), dated December 14, 2004, as

29. Prior to February, 2003, it was feasible for the San Marcos Resort to take
2 measures that would have minimized or eradicated the presence of Legionella pneumophilia in r

18 Defendants object to this request on the grounds that it is irrelevant, not reasonably
19 calculated to lead to the discovery of admissible evidence and vague, assumes facts not in
20 evidence and is nonspecific as to time, duration or concentration. Plaintiffs have not produced
2] any results of testing that took place for Legionella pneumophila: bacteria in February, 2003,
22 which indicated the presence of said bacteria in Room 126 or elsewhere on the Premises.
