On May 27, 2005, Plaintiff filed a response (#110) to Defendant Holliday's Motion for Summary Judgment (#102). Plaintiff did not provide the required separate statement of facts. Accordingly, on June 14, 2005, the Court ordered Plaintiff to file his statement of facts within twenty days. (#113). To date, Plaintiff has not done so. Plaintiff is warned that failure to file the required separate statement of facts may result in sanctions such as striking of his response, granting of Defendant's motion for summary judgment and/or dismissal for failure to comply with orders of the Court. IT IS THEREFORE ORDERED that within ten days of the filing of this Order, Plaintiff shall submit his separate statement of facts in support of his Response (#110) to Defendant Holliday's Motion for Summary Judgment (#102). Defendants shall have fifteen days from the filing of such statement of facts to reply in support of their motion.
