modifying its November 4, 2005 decision and order entered on the docket on November
4 8, 2005 together with an amendment of the Court's November 8, 2005 Judgment.
5 Plaintiff moves pursuant to Federal Rules of Civii Procedure 59 and 60 fo
6 reconsideration of this Court's decision and order issued by the Honorable Frederick J.
7 Nlartone on November 4, 2005 on the basis that this Court improperly awarded
8 compensation to defendant on its counterclaim after this Court’s finding that service
rendered by plaintiff in removing the wreckage was a “tow" under admiralty law and no
9 salvage as contended by the defendant.

11 Answering papers, if any, pursuant to Federal Rule of Civil Procedure 59 must b
12 filed within ten (10) days hereof.
