PLEASE TAKE NOTICE that at a date and time to be tixed by the Court, or as soon
thereatter as counsel may be heard, the undersigned attorneys for plaintiff ARAMARK LEISURE
SERVICES, INC. will apply to Richard I-I. Weare, United States District Court Clerk, United States
District Court for the District of Arizona, the Courthouse located at the Sandra day O’Connor U.S.
Courthouse, Suite 526, 401 West Washington Street, SPC 62, Phoenix, Arizona 85003, for an Order
modifying the Clerk’s Taxation of Costs.
Plaintiff moves pursuant to Federal Rule of Civil Procedure 54(d)(I) to review the propriety

of the Clerlds action in taxing the costs and disbursements of defendant’s Biil of Costs dated
November 10, 2005, reducing the Fees of the Clerk to exclude pro hac vice application fees,
disallowing the Fees for service ofsubpoena since service of subpoenas for the depositions ofparty
witnesses was not necessary, and modifying and/or disaiiowing the Fees for exempiitication and
copies of papers necessarily obtained for use in this case,.
