OBJECTION TO DEFENDANT'S BILL OF COSTS AND NOTICE OF APPLICATION TO HAVE COSTS TAXED

Pursuant to Local Rule 54.1(b), Plaintiff Anissa B. Groves, through counsel undersigned, objects to Defendant Wyeth's Bill of Costs. Specifically, Plaintiff objects to the taxation of fees for the exemplification and copies of papers in the amount of $4,861.56 on grounds that Defendant Wyeth has provided absolutely no evidentiary support for this amount. Under LRCiv. 54.1(e)(5), the reasonable costs of copies of papers necessarily obtained from third-party records custodians is taxable, as are reasonable costs of documentary exhibits admitted into evidence at hearing or trial. However, all other copy costs, including the costs of copies submitted in lieu of originals for the convenience of counsel or Defendant Wyeth, are not taxable. Id. Without specific identification of the documents copied (48,615 of them at $0.10 per copy), neither the Clerk nor Plaintiff can determine whether this cost is reasonable and subject to taxation under the Rule.

For this reason, Plaintiff objects to the taxation of $4,861.56 representing costs for exemplification and copies of papers and respectfully requests that the Clerk refuse to tax this amount.
