IT IS THEREFORE ORDERED AND ADJUDGED that the Court having granted Defendant Wyeth's Motion for Summary Judgment as to Plaintiff's federal law claims (Counts One and Two) and having dismissed Defendants' Wyeth and Roy's Motions for Summary Judgment without prejudice as to Plaintiff's state law claims, Plaintiff take nothing and this action is hereby dismissed.
