Defendants hereby respond to Plaintiff's Motion in Limine No. 7 regarding "collateral" evidence regarding Mark August. Defendants do not intend to call Mark August as a witness, but if Plaintiff calls Mr. August to the stand and elicits testimony regarding this incident and puts Mr. August's credibility at issue, Defendants maintain Mr. August's bias and prejudice will be relevant inquiries, and he will be subject to impeachment. One such area of impeachment may be Mr. August's efforts to convince his ex-wife not to cooperate in this case by not providing any information to Defendants. /// /// /// ///
