1.6 COME NOW THE PARTIES, by and though counsel undersigned, and
17 pursuant to Rule 41 , FED. R. CIV. P., hereby Stipulate-as to the following:
18 (I) The City .of Phoenix be dismissed with prejudice as a Defendant; and,
19 (2) Plaintiffs State Law Claims against all Defendants be dismissed with
20 prejudice.
-21 (3) The parties understand that dismissal of The City of Ph‘niX and the
22 State law claims do not have any impact on Pl-aintiffs claim under -42 U.S.C. § 1983
23 against the individual officers. Defendant City of Phoenix -and Defendant officers ‘3gTC`G
24 -that dismissal of the City do.es netamount to a- release, waiver, accord and satisfaction, or
25 limitation of Plai-ntiff’ s 42 U.S.C. § 1983 claim.

1 (4) The parties further stipulate that each will bear its costs and fees
2 incurred in respect to the claims against the City and the state law claims, and that
3 dismissal of these claims does not impair Plaintitt’-s claim for attomeys’ fees under
