1 for Partial Reconsideration of the Court’s summary judgment order dated March 28, 2007
2 (Docket Entry No. 78), and state as follows:
3 I. PROCEDURAL HISTORY
4 Defendants filed their Motion for Partial Reconsideration on April ll, 2007 (Docket
5 Entry No. 79), asking the Court to review two aspects of its Order dated March 28, 2007,
6 granting in part and denying in part Defendants’ Motion for Summary Judgment. On May 22,
7 2007, this Court ordered Plaintiff to file a Response to Defendants’ Motion for Partial
8 Reconsideration. (Docket Entry No. 81.) Plaintiff tiled her Response on June 7, 2007.
9 (Docket Entry No. 84.)
10 II. POINTS AND AUTHORITIES SUPPORTING THIS MOTION
11 Defendants request leave to file a Reply in Support of Their Motion for Partial
12 Reconsideration to respond to the new, substantive arguments raised by Plaintiff in her
13 Response. This is tantamount to a reply to a response to a motion for summary judgment
14 itself which is permitted by the Ninth Circuit. See generally Alaska VWla’ly’e Alliance iz
15 Jensen, 108 F.3d 1065, 1068 n.5 (9th Cir. 1997). Allowing Defendants to file a Reply will
16 provide the Court with a more complete understanding of the legal standards and arguments at
17 issue in this matter. A true and correct copy of Defendants’ Reply is attached to this Motion for
18 Leave as Exhibit 1.
19 III. CONCLUSION
20 With deference to this Court’s procedures and in the interests of justice, Defendants
21 respectfully request leave to file their Reply in Further Support of Their Motion for Partial
22 Reconsideration.
