1 A. That's the reason. And I was waiting for
2 Melissa to send me the paper for transfer to fill it
3 out.
4 Q. But Melissa, in her October 31 letter, is
5 also telling you that you're welcome to go back to Bell
6 Road, that there are no other openings?
7 A. Yeah, but I did no written request.
8 Q. So my question is, having received the
9 written correspondence from Melissa Kell on October 31,
10 and Miss Kappel telling you that she's not going to
11 transfer you, that you have to stay at Bell Road, why
12 didn't you go back to Bell Road?
13 A. Because I couldn't. My doctor said I cannot
14 drive so far away.
15 Q. Did you make any further requests for an
16 extension of your leave of absence after November 3,
17 2003?
18 A. No.
19 Q. And so until you started working first at
20 Fantastic Sams and now at Great Clips you were simply
21 not working?
22 A. No.
23 Q. Correct?
24 A. Correct.
25 Q. Your lawsuit is a lawsuit that's alleging

1 that you were transferred, or as we now know, that Miss
2 Kappel transferred you because of your national origin
3 and because of your age.
4 I need to ask you why are you alleging that
5 Miss Kappel transferred you because your national origin
6 is Bolivian?
7 A. That's what I assume, because I am Bolivian
8 and Cara always says she doesn't understand me. She
9 was, you know, implying those comments saying she
10 doesn't understand me because I have a strong accent.
11 And that is my point of thinking that was the reason she
12 gave me the transfer, or she wanted to get rid of me.
13 Q. Why are you alleging that Miss Kappel
14 transferred you because of your age? Why do you say
15 that?
16 A. Because in one meeting when I ask her for the
17 transfer from the Bell Road, I gave the doctor papers
18 saying —— and the doctor said it won't be a good idea
19 for me to drive too far away, but if I have close by,
20 between ten miles, it will be okay being me on
21 medication it will be okay.
22 So she said "Anyway, I have no -- no position
23 for you over there in Pavilions." And I told her I
24 don't want to go to Pavilions. "If you don't want me
25 over there give me another store in Scottsdale."
