21 ("Plaintifi") hereby requests leave of this court to file a motion for summary adjudication i
22 which exceeds the page limitations set forth in L.R.Civ. 7.2(e).
23 Plaintiff filed its motion for summary adjudication electronically with the
24 court on August l9, 2005. The memorandum in support of Plaintiffs motion contains 23
25 pages of text which encompasses twelve pages of factual background and eleven pages of
26 legal analysis in support of Plaintiffs position. Thus, out of an abundance of caution,
27 Plaintiff submits this motion for leave to file a motion for summary judgment which

3 Plaintiffs motion seeks summary judgment on its claim for relief in its

complaint for breach of contract as well as Defendant/Counterclaimants’ claim for relief

in its counterclaim for breach of contract and respectfully submits this motion for leave to

7 tile its memorandum in support of its motion for summary adjudication which, inclusive
8 of the summary of undisputed facts, exceeds the page limitation set forth in L.R.Civ.
