Pursuant to Rule 65 of the Federal Rules of C1V1l Procedure, Plaintiff Aware11ess

Corporation ("Awareness") hereby moves the Court for an Order releasing the $10,000

cash bond (the "Bond") it posted in this matter on or about October 29, 2003. Awareness
20
posted the Bond in connection with the issuance of a temporary restraining order and
21 . . . . .
preliminary injunction against all Defendants and pursuant to this Court’s October 29,
22
2003 Order . This lawsuit has been dismissed in its entirety, and Awareness is therefore

3 entitled to the release of the Bond.

For the foregoing reasons, Awareness respectfully requests that this Court enter an

Order, in the form attached, directing the Clerk of the Court to release Awareness’ Bond
