Court's obligations under the Sp eedy T rial Act, 18 U.S.C. § 3161 et seq., require that the Court hold a criminal trial on October 11-14, 2005. In addition, the Court has been informed by phone that a settlement has been reached between Plaintiff and t he Individual D e f e n d a n t s .

IT IS HEREBY ORDERED: 1. Trial in this matter shall begin on October 18, 2005 at 9:00 a.m., and shall be held on October 18-21. If a settlement has been executed by Plaintiff and

the Individual Defendants by the close of business on October 17, 2005, the trial shall concern only issues between Plaintiff and GVI. If the settlement

has not been executed by that deadline, trial shall proceed among all parties. The Court and the parties shall confer on October 21 concerning the

remaining amount of trial time required. The parties shall reserve November 8-9 and 15-16 for completion of the trial. If trial proceeds between Plaintiff and GVI on October 18-21, each side will be allotted 10 hours of trial time, which will include all trial activit ies, and the trial shall include Plaintiff's claim that a settlement agreement has been reached between Plaintiff and GVI and should be enforced by the Court. All other terms of the Court 's O rder dated August 23, 2005 (Doc. #388) shall remain in effect. DATED this 27th day of September, 2005.
